This document regulates the use of OXUM Atelier de Joalharia online store, from now on OXUM, Braga, Portugal, for the sale of jewellery.

OXUM is responsible for the online store www.oxum.pt, hereinafter referred to as the website, and undertakes to guarantee the privacy of users’ personal data. OXUM is committed to protecting and respecting the privacy of holders personal data. This policy explains how OXUM collects, protects, processes, uses and destroys, as well as guarantees the right of access and update of the personal data provided by users website.

2. Personal Information Collected and Purposes

2.1    Access to website and navigation: when accessing the website, it is automatically collected a set of computer data, which are recorded temporarily in own files, and are also automatically deleted after a certain period. The collection of these data has purely technical objectives, such as connection configuration, system security, technical management of the network and optimization of our site. The data to which we refer are the following:
a)    IP address of the requesting processor;
b)    Date and time of access;
c)    Name and URL of the transferred file;
d)    the volume of data transmitted;
e)    an indication of whether the transfer was successful;
f)    Identification data of the browser software and the operating system; g)    Web site from which you accessed our site;
h)    Name of the Internet service provider.
2.2    During the visit to the website, OXUM may collect user personal data, such as your name, address and telephone number (for example, when filling out the contact form).
2.3    Contact form: If you wish to contact OXUM directly through the website, you must fill in the form provided for that purpose, which can be found in the menu on the "Contacts" page. You will be asked for some personal information such as name, email address, location and contact. The collection of these data only aims to make it possible to respond to your contact and provide you with the information you need.
2.4    Newsletters: OXUM offers the possibility of subscribing to a free newsletters service to visitors to its website. The purpose of this service is to bring to the knowledge of its subscribers relevant information within the areas of interest covered by OXUM activity. In order to use this service, you must provide your e-mail address in the subscription form. You can cancel the subscription to the newsletters service at any time by simply clicking on the "Unsubscribe" option on the same form. If you want to re-subscribe to our newsletter, simply enter your email address again.
2.5    By using the OXUM website, you agree to accept the terms and conditions of this Privacy Policy, as explained in this section of the website. If you do not accept the terms and conditions of this Privacy Policy, we ask you not to provide OXUM with any personal data through this website.
2.6    The User guarantees that the personal data provided to OXUM are true and will be responsible for communicating any changes thereof.
 
3. Data retention period

The user’s personal data will be kept for the period necessary to comply with legal obligations. In the absence of a specific legal requirement, the user's personal data will be stored for a period of 3 years after the user's last change, update or interaction with OXUM. After this deadline, they will be eliminated.

  • satisfy requirements imposed by law or by competent governmental or judicial authorities;
  • meet the requirements necessary to establish or sustain a judicial proceeding or the defense in a lawsuit;
  • your personal data may also be reported to the police or judicial authorities in accordance with applicable laws and regulations and upon formal request from the authorities for the purpose of preventing fraud against us (anti-fraud services).
     
5. Storage personal data

Personal data collected and processed by OXUM is stored on servers with limited access, located in controlled facilities.
 
6. Data transfers abroad

Certain services provided by OXUM may imply the transfer of your data outside of Portugal. In such a case, OXUM will strictly comply with the applicable legal provisions, in particular as regards the determination of the suitability of such Country with regard to the protection of personal data and the requirements applicable to such transfers.
 
7. Data security and confidentiality

It is OXUM's objective to guarantee the quality and integrity of the information provided by the users of the website, having implemented the necessary technological and organizational measures in order to keep information secure, namely authentication / access control systems ( login and password), use of firewalls and intrusion detection systems, registration of actions taken by OXUM employees on clientes or users’ (login) personal data. 
 
8. Rights of Data Holders
 
In accordance with current legislation, the User has the right to access and rectify his/her Data, as well as the right to request its elimination, to oppose its treatment and to obtain its limitation or portability to the extent applicable. You may also object to your Data being used for the purpose of creating your customer profile; in this case, you will not be able to benefit from personalized offers or services. In addition, you may at any time request to stop receiving our communications for marketing and advertising purposes. 9. Link to social networks

We allow you to connect to social networks, but we are not responsible for your privacy and security policies. We recommend you check them out. These are links to social networks external to OXUM subject to their own Privacy Policies. These networks may record information about user activities on the Internet, including on our website. We recommend analyzing the conditions of use and the privacy policies of these social networks, in order to know exactly how they use the personal data of the users, as well as the procedure to eliminate or limit the treatment of such data. 
 
10. Children

OXUM does not knowingly collect personal data from children under the age of eighteen. If you are under the age of eighteen, do not give us any personal information. If you believe that a child has given personal data to OXUM, please contact us so that we will make every effort to delete this personal data from our databases. 
 
11. Applicable law

11.1    In case of controversy or claim of any nature related to this website, it will be applicable the Portuguese law, regardless of any conflict of laws applicable. All legal actions or proceedings arising out of or relating to this Privacy Policy, its validity, enforcement, compliance or non-compliance, or the subject matter of this Privacy Policy, shall be the responsibility of the Portuguese courts, and you consent to and submit to the jurisdiction of these courts in the cases indicated.
11.2    In the event of a litigation, the consumer may use the Resolução Alternativa de Litígios de Consumo (RAL) (Alternative Dispute Resolution - ADR) entity, as provided by the Portuguese Law no. 144/2015. In the case of OXUM, the entity to be appealed is the CIAB-Tribunal Arbitral de Consumo (ACC-Arbitration Court of Consumer), with headquarters at Rua Afonso Henriques, 1 - 4700-030 Braga, T. +351 253 617 604, www.ciab.pt.
 
12. Updates to this Privacy Policy

This Privacy, Security and Data Protection Policy is subject to change. The date of the last update to this document is indicated by the caption "Updated in" in the heading of this document. Changes to this Privacy Policy will take effect at the time of its publication on the website.
